Service Agreement for the website karunajyotish.com

This English text is a translation provided for convenience. The agreement is concluded in Ukrainian. In the event of any discrepancy between versions, the Ukrainian version published on the website shall prevail.

1. General Provisions

This document is an official public offer (proposal) by individual entrepreneur (FOP) Kyrylo Mykolaiovych Molodetskyi (hereinafter — the "Provider") to conclude a service agreement on the terms set out below.

Payment for services on the website constitutes full and unconditional acceptance of this offer by the person making the payment (hereinafter — the "Customer") and constitutes conclusion of the agreement pursuant to Articles 633, 641, and 642 of the Civil Code of Ukraine, taking into account the provisions of the Law of Ukraine "On Electronic Commerce" and the Law of Ukraine "On Digital Content and Digital Services".

2. Subject of the Agreement

The Provider grants the Customer access to one or more paid services of the website:

• extended astronomical and astrological calculations (the "Details" section) — for a term of 6 or 12 months;
• the "Karuna Jyotish" educational course — monthly access or access to the full course (6 months);
• personal consultations, the terms, cost, and payment procedure of which are agreed by the parties individually and paid separately outside the automatic checkout on the website.

The specific list, scope, and term of access are determined by the option selected by the Customer on the checkout page.

3. Cost and Payment Procedure

The cost of each service is indicated on the relevant checkout page of the website and is current as of the time of payment.

Payment is made by bank cards in Ukrainian hryvnia (UAH) via the monobank acquiring service.

A service is deemed paid from the moment the payment system confirms a successful transaction.

4. Procedure for Granting Access

Access to the digital content or website functionality is granted automatically immediately after payment confirmation and is linked to the Customer’s account. A notification confirming successful access, including its validity period, is sent to the Customer’s email.

In the event of a technical delay, the Provider opens access manually within one business day after receiving a corresponding request at info@karunajyotish.com.

The start of the service is deemed to be the moment access to the digital content or website functionality is opened.

5. Refunds and Right of Withdrawal

By paying for access to the digital content or website functionality, the Customer gives express prior consent to the commencement of performance of the agreement before the expiry of the withdrawal period.

The Customer acknowledges being informed and agrees that, after access to the digital content is actually opened, the Customer loses the right to withdraw from the agreement pursuant to clause 1 of part 5 of Article 13 of the Law of Ukraine "On Consumer Protection" and the relevant provisions of the Law of Ukraine "On Digital Content and Digital Services".

If access was not granted through the fault of the Provider, the amounts paid are refunded in full within 7 (seven) business days from receipt of the corresponding request at info@karunajyotish.com.

6. Rights and Obligations of the Parties

The Provider undertakes to:

• grant the Customer access to the paid services of proper quality;
• ensure the proper functioning of the service, except during maintenance periods or circumstances beyond the Provider’s control.

The Customer undertakes to:

• provide accurate information when placing an order;
• not transfer access to their account to third parties;
• use the services in accordance with their intended purpose.

7. Liability of the Parties

The parties bear liability in accordance with the applicable legislation of Ukraine.

The Provider is not liable for the inability to provide services caused by force majeure, disruptions in the operation of the Internet, payment systems, or other services beyond the Provider’s control.

The Provider does not guarantee that the Customer will achieve any specific results from using the service, completing the course, or receiving a consultation.

The information provided through the website, calculations, course, consultations, and other services is of an exclusively informational, educational, and worldview nature. It does not guarantee the occurrence, non-occurrence, or accuracy of any prediction of any events and does not constitute medical, psychological, legal, financial, or other professional advice. Any decisions made on its basis are taken by the Customer independently and at their own risk.

8. Personal Data

Processing of the Customer’s personal data is carried out in accordance with the Privacy Policy published on the website and the requirements of the Law of Ukraine "On Personal Data Protection".

9. Intellectual Property

All website materials, course materials, texts, video, audio, images, program code, calculation results, and other content are objects of the Provider’s intellectual property rights or are used by the Provider on lawful grounds.

The Customer is granted a non-exclusive right to personal use of the purchased content, without the right to copy, distribute, publicly post, transfer to third parties, or use it commercially without the Provider’s written consent.

10. Maintenance

The Provider has the right to temporarily restrict access to the website or individual services for maintenance, software updates, or the elimination of technical faults. Such interruptions are not considered improper provision of services.

11. Dispute Resolution

The parties shall seek to resolve all disputes through negotiations.

If no agreement is reached, the dispute shall be resolved in court in accordance with the legislation of Ukraine.

12. Validity of the Offer

This offer takes effect from the moment of its publication on the website and remains in force until it is withdrawn or a new version is published.

The Provider has the right to amend this offer by publishing a new version on the website. Legal relations that arose before the amendments are governed by the version of the offer in force at the time of payment.
